Common Law / Natural Law Jurisdiction

Romans 2:14, 15 Amplified 

"When the Gentiles who have not the (divine) Law, do instinctively what the Law requires, they are

a law to themselves, since they do not have the Law.  They show that the essential requirements of 

the Law are written in their hearts and are operating there, with which their consciences (sense of

right and wrong) also bear witness; and their (moral) decisions will accuse or perhaps defend and excuse them."   This is "common law" or "natural law"!  It is written in our hearts.

Law of the Land- COMMON LAW

AKA: Common Sense

Natural Law as defined by Bouvier's Law Dictionary, 1839:  The Law of Nature is that which God, the sovereign of the universe, has prescribed to all men

Natural Law as defined by Noah Webster, 1828: Is a rule of conduct arising out of the natural relations of human beings established by the Creator, and existing prior to any positive precept.  Thus it is a law of nature, that one man should not injure another, and murder and fraud would be crimes, independent of any prohibition from a supreme power.

Common Law as defined by Noah Webster, 1828: Unwritten, or common law, a rule of action which derives its authority from long usages, or established custom, which has been immemorially received and recognized by judicial tribunal.  As this law can be traced to no positive statues, its rules or principles are to be found only in the records of courts and in the reportst of judicial decisions.

Common Law as defined by Black's Law Dictionary 5th ed.: "Consists of those principles, usages and rules of action applicable to government and security of person and property which do NOT rest for their authority upon any express and positive declaration of the will of the legislature."

-When a crime occurs, between two living souls, the people implement the use of Common Law Courts and Common Law Grand Juries and Petit Juries made up of the people, who determine the law and the facts as well as the sentence. There are no "Judges"- Only Justice's of the Peace and the Jury.

Common Law applies to mankind: men and women functioning in the private realm (as compared to public or commercial realm).   See Definitions for Public Law, Private Law, Commerce.

Common Law is very simple: Do unto others as you would have done unto you.

-Cause no harm, no injury, no loss to anyone's body or property

-Take responsibility for your actions

-Be honest and truthful

-Honor your contracts

Common Law Action:  Action governed by common law rather than statutory, equitable or civil law.

Article 7 of the Bill of Rights (7th Amendment):  "In suits at common law where the value in controversy shall exceed twenty dollars, the right of a trial by jury shall be preserved and no fact tried by a jury shall be otherwise re-examined in any Court of the United States, than according to the rules of the common law."

Also reference the Northwest Ordinance of 1787:   "...The inhabitants of the said territory shall always be entitled to the writ of habeas corpus, and of the trial by jury; of a proportionate representation of the people in the legislature; and of judicial proceedings according to the course of the common law.."  Further more:   "...whenever any of the said States shall have sixty thousand free inhabitants therein, such State shall be admitted, by its delegates, into the the Congress of the United States, on an equal footing with the original States in all respects whatever, and shall be at liberty to form a permanent constitution and State government:  Provided, the constitution and government so to be formed, shall be republican, and in conformity to the principles contained in these articles; and, so far as it can be consistent with the general interest  of the confederacy, such admission shall be allowed at an earlier period, and when there may be a less number of free inhabitants in the state than sixty thousand."

Governments are Created by the People

-To secure and protect their vast number of God-given, UNALIENABLE rights and

-To provide certain services for the people that the people identified, and authorized them to provide.

Quite literally our government is a "service organization" which is subject to the scrutiny of the people (men and women) who have created it.

-Also known as a Body Politic.

The people have given "government" limited power and authority to deal with services primarily involved in ADMIRALTY / MARITME LAW Jurisdiction

AKA: The Law of the Sea/Water 

-which applies to fictional or dead entities or corporations involved in commerce. (NOT living men & women)

Admiralty/Maritime Law as defined by Blacks Law Dictionary 5th Ed. :  "That which the Congress has enacted or the Federal courts,  sitting in admiralty, or in the exercise of their maritime jurisdiction, have declared and would apply...That system of law which relates to marine commerce and navigation, to business transacted at sea or relating to navigation to ships and shipping, to seamen, to the transporting of persons and property by sea....  Substantively, in the United States, it is federal law, and jurisdiction to administer it is vested in the federal courts, though not to the entire exclusion of the courts of the states."  (A ship is also known as a vessel.)

State and Federal Governments have 3 Departments:

-Executive

-Legislative

-Judicial

-Each branch has specific duties and responsibilities that only apply to the business of the government and the services it supplies to the people and to its employees (called "public servants).

-And each branch exists to keep the others in check:  "checks & balances" to make sure the government is not overstepping it's bounds (water jurisdiction-fictional entities) into the lives and rights of the men and women (land jurisdiction- living / non-fictional entities)

-NONE of the government policies known as statutes, acts, codes, mandates or orders apply to living men and women!  They only apply to the government departments and its employees (public servants). 

- All governments ANSWER TO the men and women who created them as do the elected public servants who fill the positions within the service organization.  

-The People oversee and audit public servants and government offices through the process of "petitioning the government for a redress of grievances" and the Common Law Grand Jury.
